Certain felony convictions can be reduced to misdemeanors pursuant to Penal Code section 17(b). Those felonies are known as “wobblers”.

Certain misdemeanor convictions can be reduced to infractions pursuant to Penal Code section 17(d)(2). Those misdemeanors are known as “wobblettes”. A list of most of the offenses that can be reduced from misdemeanors to infractions can be found in Penal Code section 19.8.

When we prepare and submit 1203.4 Petitions for Dismissal, we will also request that any eligible felonies be reduced to misdemeanors, and that any eligible misdemeanors be reduced to infractions.

Requests for reductions may be possible during your term of probation if there was an agreement for that which is a part of the court file. This means it would be a part of your plea form and/or a part of the court minutes.
