Modification of Sentence from 365 Days to 364 Days (for immigration cases)

Governor Brown signed a law that makes a California misdemeanor have a maximum possible sentence of 364 days. This law allows persons who were sentenced to a term of one year prior to January 1, 2015, to submit an application before the trial court that entered the judgment of conviction in the case to have the term of the sentence modified to the maximum term of 364 days.

This law is applicable to citizens and non-citizens alike; however, it may provide crucial help to those non-citizens who are convicted of minor offenses that are seeking immigration relief.
